1. Acceptance of Terms

Welcome to Naither.com ("Platform"), a social commerce platform that connects buyers and sellers for seamless transactions. By accessing, browsing, or using Naither.com, you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these Terms, you must not use the Platform. These Terms apply to all users, including visitors, registered users, buyers, and sellers.

2. Eligibility

To use Naither.com, you must be at least 18 years old and have the legal capacity to enter into contracts. By using the Platform, you represent and warrant that you meet these eligibility requirements. Naither.com reserves the right to refuse access to the Platform to anyone who does not meet these criteria or for any other reason at our discretion.

3. User Conduct

You agree to use Naither.com in a manner that is lawful, responsible, and respectful. You are prohibited from:

• Posting or sharing content that is illegal, defamatory, obscene, threatening, harassing, or otherwise harmful.
• Engaging in fraudulent activities, including misrepresenting products or services.
• Posting misleading, false, or inaccurate product descriptions, prices, or availability.
• Using automated tools (e.g., bots, scrapers) to access or collect data from the Platform without permission.
• Attempting to interfere with the Platform's functionality, security, or integrity, including hacking or spreading malware.
• Engaging in spamming, phishing, or other abusive behaviors.

Naither.com reserves the right to remove any content that violates these Terms and to take appropriate action against users who engage in prohibited conduct.

4. Transactions and Payments

Naither.com facilitates transactions between buyers and sellers through secure UPI-based payment methods (Unified Payments Interface). We do not support PayPal or other payment methods at this time. Key details about transactions include:

• Direct Payments: Payments are processed directly between buyers and sellers via UPI. Naither.com does not hold or escrow funds.
• Commission: We do not charge any commission. Any fees charged will either be by a UPI partner or the processing bank
• No Additional Buyer Fees: Buyers are not charged any additional platform fees beyond the product price as mentioned on the product listing
• Transaction Security: Users must ensure that UPI transactions are conducted securely, using verified UPI IDs. Naither.com is not responsible for errors in UPI ID entry or fraudulent payment attempts.
• Refunds and Disputes: Naither.com provides a platform for a direct transaction between buyer and seller. Ultimate responsibility for resolving issues lies with the buyer and seller. We encourage clear communication to resolve disputes amicably. We can only either suspend or terminate buyer or seller accounts based on feedback received by the parties and the community as a whole

Sellers are responsible for ensuring accurate product listings, including descriptions, prices, and availability. Buyers are responsible for verifying product details before completing a purchase.

5. Account Responsibilities

When you create an account on Naither.com, you agree to:

• Provide accurate, current, and complete information during registration and keep it updated.
• Maintain the confidentiality of your account credentials (username, password, and UPI details).
• Be responsible for all activities conducted under your account, including purchases, sales, and posted content.
• Notify Naither.com immediately at our contact page if you suspect unauthorized use of your account or a security breach.

Naither.com is not liable for any loss or damage arising from your failure to secure your account.

6. Content Ownership and Licensing

You retain ownership of the content you post on Naither.com, including product listings, images, and descriptions. By posting content, you grant Naither.com a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely for the purpose of operating and promoting the Platform. You represent and warrant that your content does not infringe on the intellectual property rights of others.

7. Termination and Suspension

Naither.com reserves the right to suspend or terminate your account or access to the Platform at our sole discretion, without prior notice, for reasons including but not limited to:

• Violation of these Terms or any applicable laws.
• Fraudulent activity, including misrepresentation of products or payment disputes.
• Abuse of the Platform, such as spamming, harassment, or posting harmful content.
• Repeated failure to fulfill transaction obligations as a buyer or seller.

Upon termination, you will lose access to your account, and any pending transactions may be canceled. Naither.com is not liable for any losses resulting from account termination.

8. Limitation of Liability

Naither.com provides a platform to facilitate transactions but is not a party to the transactions between buyers and sellers. We are not liable for:

• Disputes arising from transactions, including non-delivery, defective products, or payment issues.
• Losses, damages, or injuries resulting from the use of products purchased through the Platform.
• Errors or interruptions in UPI payment processing caused by third-party services or user errors.
• Any indirect, incidental, or consequential damages arising from your use of the Platform.

While we provide a dispute resolution process to assist users, the responsibility for resolving transaction disputes lies with the buyer and seller. Naither.com’s liability is limited to the extent permitted by applicable law.

9. Intellectual Property

All content on Naither.com, including logos, designs, text, and software, is the property of Naither.com or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, modify, or distribute our content without prior written permission.

10. Privacy

Your use of Naither.com is also governed by our Privacy Policy, available at Privacy Policy. The Privacy Policy outlines how we collect, use, and protect your personal information, including data related to UPI transactions.

11. Modifications to Terms

Naither.com may update these Terms at any time by posting the revised version on this page. The updated Terms will be effective as of the "Last updated" date at the top of this page. Your continued use of the Platform after any changes constitutes your acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts in Noida,Uttar Pradesh State, India.
